About these terms
Alpage is operated by COCO Software Ltd, a company registered in England and Wales (company number 13387646), whose registered office is at 56 Cowleigh Bank, Malvern, England, WR14 1PH. In these terms, "Alpage", "we", "us" and "our" mean COCO Software Ltd trading as Alpage. You can contact us at hello@alpageapp.com.
These terms have three parts:
- Part A applies to everyone who uses Alpage.
- Part B applies if you buy a paid subscription, personal or business.
- Schedule 1 applies if, as a business customer, you upload personal data about other people, such as your guests.
Our Privacy Policy explains how we handle personal data.
A1. The guide is general information
We check, date and update what we publish, and we tell you plainly when something is shut, hard to reach or only for experienced people. But things in the mountains change quickly: opening hours, road and lift closures, prices, snow cover and avalanche conditions.
Always check locally before you rely on anything in Alpage, and especially before doing anything where your safety depends on it. Alpage is not a substitute for the official avalanche bulletin, a qualified mountain guide, the pisteurs or the emergency services.
In an emergency in France, call 112.
A2. Your account
You sign in to Alpage with your Google account. You're responsible for keeping that account secure and for what happens under it.
A3. Using Alpage properly
Please don't:
- copy, scrape or republish our content in bulk, or use automated tools to extract it
- try to interfere with the site, get around its security, or access accounts that aren't yours
- use lists or shared guides to publish anything unlawful, misleading, offensive or that infringes someone else's rights
- pretend to be someone else, or a business you don't represent
We can suspend or close accounts that break these rules.
A4. Our content
The guide content on Alpage, including text, listings, photographs and the site design, belongs to us or the people who license it to us. You're welcome to use it for your own personal, non-commercial purposes. Paid subscribers get a wider licence under Part B.
A5. Affiliate links and other sites
Some links on Alpage are affiliate links. If you book or buy something after clicking one, we may earn a commission. It never changes the price you pay, and it doesn't decide what we write or recommend.
Links to other sites are there for your convenience. We don't control those sites and aren't responsible for their content, availability or what they do with your data.
A6. The free service
The free version of Alpage is provided as it is. We may change, add or remove features, and we can't promise it will always be available or free of errors.
A7. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
If you use Alpage as a consumer, you have legal rights that these terms don't take away. Subject to that, we aren't responsible for losses that weren't a foreseeable result of something we did wrong, and we aren't responsible for any business losses if you use the free service for business purposes.
B1. Who can subscribe
Anyone aged 18 or over can buy a paid subscription, either for themselves or for a business. When you subscribe, you'll tell us which:
- a personal subscription is for your own use, for example sharing lists with friends and family
- a business subscription is for use in a business, for example by a chalet company, property manager or hotel
Some parts of these terms are different depending on which you choose. Where that's the case, it says so. If you subscribe for a business, you confirm you have authority to accept these terms for it, and "you" means that business.
B2. What's included
A paid subscription includes:
- unlimited lists
- custom branding: your text, colours and logo
- branded guides and lists you can share
- guest lists, where available, for business subscriptions
We may add features over time. We won't remove a core feature from an active subscription without giving you at least 30 days' notice.
Free trial. You can try a paid subscription free for 14 days. We don't ask for card details and you won't be charged. When the trial ends, your account goes back to the free version unless you choose to subscribe. Anything you created during the trial is kept, but lists beyond the free allowance become read-only and anything you've shared stops showing your branding until you subscribe. The free trial is available once per person or business.
B3. Price and payment
The price is shown on our pricing page and at checkout. Personal subscription prices include VAT. Business subscription prices are shown excluding VAT.
Subscriptions are billed monthly in advance through Stripe and renew automatically each month until you pause or cancel.
VAT for business subscriptions. If you're a UK business, we'll add UK VAT. If you're a VAT-registered business in the EU, please give us your valid VAT number when you subscribe; the reverse charge will apply and we won't charge VAT. In any other case, we'll charge VAT wherever the law requires it.
Failed payments. If a payment fails, Stripe will retry it and we'll email you. If it's still unpaid after 14 days, your account will switch to read-only until payment is made.
B4. Launch pricing
If you subscribed at a launch or founding price, that price is fixed for 24 months from the date you first subscribed. After that, the standard price applies, and we'll remind you at least 30 days before it changes.
B5. Price changes
We may change the price of the subscription. We'll give you at least 30 days' notice by email, and you can cancel before the new price takes effect.
B6. Pausing
You can pause your subscription at any time from your account settings, for example between seasons.
While your subscription is paused:
- billing stops from your next billing date
- your account becomes read-only
- anything you've shared still works, but without your branding
- everything is kept exactly as you left it: your logo, colours, lists and settings
You can resume at any time and everything will be back as it was. Billing restarts from the day you resume.
B7. Cancelling
You can cancel at any time from your account settings. Cancellation takes effect at the end of the month you've already paid for. We don't refund part-months, except under B8 (personal subscriptions) and B9 (business subscriptions).
When you cancel:
- your account becomes read-only and anything you've shared stops showing your branding
- we keep your account, branding and lists for 24 months in case you come back, then delete them
- any guest data a business has uploaded is deleted 90 days after cancellation
- you can ask us to delete everything sooner, and you can ask for an export of your lists before you go
B8. Your right to cancel (personal subscriptions)
If you have a personal subscription, you have a legal right to cancel within 14 days of starting your paid subscription, without giving a reason. The free trial doesn't count towards the 14 days, because it's free and you choose separately whether to subscribe. To do this, cancel from your account settings or email hello@alpageapp.com saying you want to cancel.
When you subscribe, you ask us to start your subscription straight away. If you then cancel within the 14 days, we'll refund what you paid minus a proportionate amount for the days you've already used. We'll refund you within 14 days of you telling us, to the card you paid with.
This legal right doesn't apply to business subscriptions.
B9. Money-back guarantee (business subscriptions)
If you have a business subscription and you're not happy with Alpage during your first 90 days, email us and we'll refund every subscription payment you've made in that period. No conditions, no questions. We'll refund you within 14 days, to the card you paid with. This guarantee is available once per business.
B10. Your content
Your logo, text, lists and anything else you upload stay yours.
You give us a non-exclusive, worldwide, royalty-free licence to host, store, display and reproduce that content, only so far as we need to in order to provide the service, including showing what you share to the people you share it with. This licence ends when your content is deleted.
You confirm that you own or have permission to use everything you upload, including your logo, and that it isn't unlawful, misleading or infringing anyone else's rights. We may remove content that breaks this section. If you have a business subscription and a claim is made against us because something you uploaded infringes someone else's rights, you'll cover our reasonable costs of dealing with it.
B11. Our guide content in your branded guide
While your subscription is active, you have a non-exclusive, non-transferable licence to display Alpage guide content inside your branded guides and lists.
You can't copy our content out of Alpage for use elsewhere, resell it, or present it as your own writing. Branded guides will show a small "Guide content by Alpage" credit.
B12. Availability
We'll use reasonable care and skill to keep Alpage running and to keep our content accurate and up to date. We can't guarantee the service will be uninterrupted or error-free, and we may need to take it offline for maintenance.
B13. Our liability to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow us to limit.
Personal subscriptions. You have legal rights, including that our service will be provided with reasonable care and skill and will be as described. Nothing in these terms affects those rights. Subject to them, we aren't responsible for losses that weren't a foreseeable result of something we did wrong, or for any business losses.
Business subscriptions. Subject to the first paragraph of this section:
- we are not liable for loss of profit, revenue, business, bookings, goodwill or anticipated savings, or for any indirect or consequential loss
- you are responsible for checking information before you pass it on to your guests as your own advice, particularly anything to do with safety, access or opening times
- our total liability to you in any 12-month period is limited to the subscription fees you paid us in that period
B14. Suspension and termination by us
We may suspend or close your account if you don't pay, or if you seriously or repeatedly break these terms. Where we reasonably can, we'll tell you first and give you a chance to put it right.
If we decide to stop offering paid subscriptions, we'll give you at least 30 days' notice and refund anything you've paid for time after the service ends.
B15. Data protection
If you have a business subscription and upload personal data about other people, such as your guests or staff, Schedule 1 applies and forms part of these terms.
B16. General
- Changes to these terms. We may update these terms. We'll give you at least 30 days' notice by email of any change that affects your subscription. If you don't agree, you can cancel before it takes effect.
- Whole agreement. These terms, together with Schedule 1 and our Privacy Policy, are the whole agreement between us about your subscription.
- Transfer. You can't transfer your subscription without our agreement. We may transfer our rights and obligations to another organisation, for example if Alpage is sold, and we'll tell you if that happens.
- Third parties. No one other than you and us has any right to enforce these terms.
- Events outside our control. We aren't responsible for delays or failures caused by events outside our reasonable control.
- Notices. We'll contact you by email at the address on your account. You can contact us at hello@alpageapp.com.
- Law and courts. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you have a personal subscription and live elsewhere, you keep the protection of the mandatory consumer laws where you live, and you can bring a claim in your local courts.
This Schedule applies where you, as a business customer, upload or instruct us to process personal data about other people through Alpage ("Customer Personal Data"). It is designed to meet the requirements of Article 28 of the UK GDPR and, where it applies, the EU GDPR.
1. Roles
For Customer Personal Data, you are the controller and we are your processor.
2. Details of the processing
- Purpose: providing Alpage's branded guide and guest list features to you.
- Duration: for as long as your subscription lasts, plus the deletion period in paragraph 3.
- Types of personal data: guest names, email addresses, phone numbers, stay dates, and any other details you choose to add.
- People the data relates to: your guests and, where relevant, your staff.
3. What we'll do
We will:
- process Customer Personal Data only on your documented instructions. These terms, and your use of Alpage's features, are your instructions. If we're legally required to do something else, we'll tell you first unless the law prevents us.
- make sure anyone we authorise to process it is bound by confidentiality.
- keep it secure, using appropriate technical and organisational measures, including encryption in transit and at rest, and access restricted to people who need it.
- help you, where reasonably possible, to respond to people exercising their data protection rights, and with any data protection impact assessment or consultation with a regulator.
- tell you without undue delay, and in any case within 48 hours of becoming aware, if there's a personal data breach affecting Customer Personal Data, and give you the information you reasonably need to deal with it.
- delete Customer Personal Data 90 days after your subscription ends, unless the law requires us to keep it. You can export or delete it yourself before then.
- make available the information you reasonably need to show we're meeting these obligations, and allow audits on at least 30 days' notice, no more than once a year, at your cost.
4. Sub-processors
You give us general permission to use sub-processors. Our current sub-processors for Customer Personal Data are:
| Sub-processor | What they do |
|---|---|
| Supabase Inc. | Database and storage |
| Lovable | Website hosting |
We'll give you at least 30 days' notice by email before adding or replacing a sub-processor. If you object on reasonable data protection grounds, you can cancel your subscription before the change takes effect. We'll make sure each sub-processor is bound by data protection obligations at least as protective as these, and we remain responsible to you for their work.
5. International transfers
We'll only transfer Customer Personal Data outside the UK or EEA where there's an appropriate safeguard in place, such as UK adequacy regulations, the UK International Data Transfer Agreement, or the EU Standard Contractual Clauses with the UK Addendum.
6. Your responsibilities
You're responsible for:
- having a lawful basis for giving us Customer Personal Data
- telling your guests that you use Alpage to share guides and information with them
- only uploading the personal data you actually need
